This Agreement (“Agreement”) is a contract between you (“Licensee”) and Jasmine Gump of Pixel and Papier LLC (“Licensor”) for the use of the Product created by Jasmine Gump. By subscribing on Thangs.com or downloading the Licensed Material, you agree to be bound by the terms and conditions of this Agreement.

Grant of License

Licensor hereby grants Licensee a non-exclusive, non-transferable, revocable license to use the digital content (“Licensed Material”) provided by Licensor under the following tiers:

1. Personal Use Tier: Maker Lite

  • For personal use only. All models in this tier are strictly for non-commercial purposes.
  • Although attribution is not required, it would be greatly appreciated if you credit “Pixel and Papier” when sharing personal projects.
  • Selling, distributing, or sharing digital files is prohibited. Creating derivatives or remixes is not allowed.
  • No commercial rights are granted under this tier.

2. Commercial Use Tiers: Early Adopter, Maker, Super Maker

  • Authorized to sell physical 3D prints made from the Licensed Material.
  • Although attribution is not required, it would be greatly appreciated if you credit “Pixel and Papier” when sharing projects.
  • Limited to 1,000 physical end products per design per calendar year. Contact Licensor at pixelandpapier@gmail.com to request permission to exceed this limit.
  • Selling, distributing, or sharing digital files is prohibited. Creating derivatives or remixes is not allowed.

3. Individual File Purchases on Thangs

Files purchased individually on Thangs are subject to the same terms as the tiers above:

  • Upon cancellation of a Commercial Use subscription, any individually purchased files may continue to be used for personal, non-commercial purposes only—no further commercial use is permitted.
  • For personal use only unless you hold an active Early Adopter, Maker, Super Maker subscription.
  • If you hold a Early Adopter, Maker, Super Maker subscription, you may sell up to 1,000 physical end products per design per calendar year, as described in Section 2.
  • Selling, distributing, or sharing the digital files themselves is prohibited.
  • Creating derivatives or remixes is not allowed.
  • No AI training or generative use is permitted (see detailed restriction below).

Active Subscription Required

Applicable to Commercial Use (Early Adopter, Maker, Super Maker ) Tiers: Licensee must maintain an active subscription on Thangs.com to continue selling physical items derived from the Licensed Material commercially.
Upon cancellation of the subscription, Licensee may continue to use the Licensed Material for personal, non-commercial purposes only. No further commercial use is permitted without an active subscription.

Not Applicable to Personal Use Tier (Maker Lite) and Individually Purchased Files: The Personal Use Tier is for non-commercial purposes only, and this condition does not apply.

Specific Use Restriction

This license is limited to the 3D printing method of manufacturing. Use with other manufacturing methods is prohibited.

Physical Items Only

Applicable to All Tiers: Licensee is authorized to create physical items from the Licensed Material. However:

  • Personal Use (Maker Lite) Tier/Individually Purchased Files: Physical items must be for personal use only, not for sale.
  • Commercial Use Tiers (Early Adopter, Maker, Super Maker): Licensee may sell physical items within the 1,000-product limit.

Selling, distributing, or sharing the digital files themselves is strictly prohibited across all tiers.

Restrictions

Licensee shall not distribute, sell, license, sub-license, or otherwise make available the Licensed Material to third parties. The Licensed Material shall not be used in any manner not expressly authorized under this Agreement.

Intellectual Property

The Licensed Material is the property of Licensor and is protected by copyright and other applicable intellectual property laws. Licensee acknowledges that it does not acquire any ownership rights by downloading or using the Licensed Material.

Termination

Licensor may terminate this Agreement immediately upon Licensee’s breach of any terms herein. Licensee must cease all use of the Licensed Material and destroy all copies of the Licensed Material in their possession upon termination.

No AI Training or Generative Use

The files, designs, models, or any other materials provided under this agreement may not be used for the training, development, or fine-tuning of artificial intelligence systems, machine learning models, or data mining tools. Additionally, these materials may not be used as input, prompts, references, or data sources for generating AI-assisted content or derivative works, including but not limited to AI-generated art, images, 3D models, or animations.

Limitation of Liability

Licensor shall not be liable for any indirect, special, incidental, or consequential damages arising out of or related to this Agreement, whether or not such damages were foreseeable.

Indemnification

Licensee agrees to indemnify, defend, and hold harmless Licensor from and against any claims arising from the use of the Licensed Material.

No Warranties

Licensor provides the Licensed Material “as is,” and disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Effective Date

This Agreement is effective as of the date of your download or purchase confirmation received from Thangs.com.

Acknowledgment

By subscribing to a Pixel and Papier LLC’s Thangs and downloading the Licensed Material from Thangs.com, you acknowledge that you have read, understood, and agree to the terms and conditions of this Agreement.
